Duties

Attorney-Adviser (General) GS-0905-13

  • Serves as the principle professional legal adviser to the United States Property and Fiscal Officer (USPFO), state/territory National Guard senior leadership, state/territory National Guard directorates, and subordinate National Guard commanded units or state/territory level divisions.
  • Acts as a legal adviser and attorney for the state/territory National Guard, responsible for the formulation of state/territory legal policy and its execution legal representation; legal initiatives; interpretation and litigation of U.S. and state/territory(s) constitutional, civil, criminal, labor law; international law and treaty agreements; trial defense; and a full spectrum of expert legal advice.
  • Responsible to advise on the legal, factual and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, opinions or other guiding, or lack there of, instruments associated with emerging or highly conflicted and emotionally charged issues such as intelligence oversight related to Homeland Security, or advising on Federal and state/territory Executive Orders for the use of federalized troops in response to domestic emergencies and natural disasters.
  • Serves as the state/territory National Guard litigation point of contact.
  • Serves as an attorney/adviser providing acquisition and fiscal legal advice to the state/territory's assigned United States Property & Fiscal Officer (the Chief of the National Guard Bureau's agent in the state/territory) and active-duty military advisers. Advises Army National Guard (ARNG) and Air National Guard (ANG) contracting officers, reviews contracts, procurement actions and real property matters involving Federal and state/territory funds (some involving substantial amounts of money) for legal sufficiency, appropriate titling and claim initiation or resolution actions. Provides advice and legal assistance in bid protest matters and represents the National Guard in disputes before fiscal and contract administrative and judicial forums.
  • Acts as the Adjutant General's representative in third-party proceedings under Federal labor-management and equal employment opportunity statutes and regulatory provisions.
  • Advises the convening authorities, including the state/territory Adjutant General, on procedural and legal issues associated with Courts Martial, Non-Judicial Punishment Administrative Board proceedings and subsequent actions.
  • Serves as the state/territory Ethics Adviser. Reviews sensitive financial disclosure statements for General Officers and other key personnel.
  • Serves as claims officer for the state/territory National Guard.
  • Provides oversight and guidance to the state/territory Judge Advocate's Legal Office, Legal Assistance and Preventative Law Programs, and supervises assigned full-time attorney and support staff.
  • Performs other duties as assigned.

Appointment Factor(s): This is an Excepted Service position that requires active membership in the Texas National Guard and wear of the military uniform. Applicants who are not currently a member of the Texas National Guard must be eligible for immediate membership and employment in the Texas National Guard.

Areas of Consideration: Nationwide Excepted. This includes:

  • All currently employed full-time permanent, indefinite and temporary personnel of the Texas National Guard.
  • All current members of the Texas National Guard and individuals eligible for immediate membership in the Texas National Guard.
Conditions of Employment and Remarks:
  • Must be able to obtain and maintain the appropriate security clearance of the position.
  • May occasionally be required to work other than normal duty hours; overtime may be required.
  • As an Officer in the Army National Guard JAG Corps, must have completed the 14-week Judge Advocate General Basic Course.
  • As an Officer in the Air National Guard, must have completed the nine-week Judge Advocate Staff Course.
  • No record of conviction by civilian courts of offenses listed in the applicable Service Military Justice regulations. Must not have any military disciplinary action (Article 15 or Court-Martial) on military records for engaging in an unprofessional or inappropriate relationship as defined in applicable DoD Instructions concerning Army and Air Force Professional and Unprofessional Relationships.
  • Must not have any Unfavorable Information Files, civil convictions (other than minor traffic violations), or open Inspector General investigations.
  • May be required to successfully complete a probationary period.
  • Direct deposit is mandatory.

Medical requirements:
Series GS-0905 applicants must have the capacity to perform essential functions and operations without risk to themselves or others. Applicants must meet the military skill classification, military experience qualification, and military physical and mental health requirements as applicable and directed by the Department of Defense, the Department of the Army and/or the Department of the Air Force. Prior to appointment, the selected candidate must provide the following:
1. A current and completed medical physical with a cleared drug test.
2. Normal color vision as defined in Army or Air Force Medical Examinations and Standards.
3. No record of claustrophobia or claustrophobic tendencies.

Qualifications

To qualify at the GS-09 grade level your resume must include relevant experience with beginning and ending dates of employment/experience reflecting the following:

Specialized Experience Required
Must have at least 24 monthsexperience, education, or training involving detailed knowledge of organizations and their functions in logistical support (i.e., supply, maintenance, quality assurance, facilities), experience integrating actions of a variety of specialized support activities in order to meet program goals, experience interpreting and applying regulations, laws or practices, and experience planning and organizing work assignments.

For entry into the Air National Guard JAG Corps/ Attorney-Adviser, it is mandatory to have a Bachelor of Laws or Juris Doctor degree in law issued by an ABA- accredited law school; and must be admitted to practice law in the highest court of any U.S. state, commonwealth, territory or the District of Columbia.

Air National Guard Officers:
For entry into the Air National Guard JAG Corps/Attorney-Adviser, it is mandatory to have a Bachelor of Laws or Juris Doctor degree in law issued by an ABA-accredited law school; and must be admitted to practice law in the highest court of any U.S. state, commonwealth, territory or the District of Columbia.
