S&B USA Construction (SBC) is a subsidiary of Shikun and Binui Ltd., headquartered in Pittsburgh, Pennsylvania that operates in multiple states in the US and provides Design and Construction of small and large scale projects in any of the traditional or alternative delivery methodologies currently being utilized in the industry. Fay Construction is a 100% owned SBC subsidiary that is a construction industry leader in the Mid-Atlantic region.

The Project:
The SR 400 Express Lanes project will construct express lanes on an approximately 16-mile section of SR 400 from the Metropolitan Atlanta Rapid Transit Authority (MARTA) North Springs Station (Exit 5C) in Fulton County to approximately 0.9 miles north of McFarland Parkway (Exit 12) in Forsyth County. It will be awarded in Q3 2023 and, upon completion, it is estimated to be over $2B.
The project is being delivered under a DBFOM that guarantees early involvement and increased collaboration between the Owner (GDOT), the Developer (a JV S&B Concessions and ASTM) and the Design Builder (a JV S&B Construction, Halmar International and FCC). The RFP phase will be delivered starting in September 2022 and will last until Q3 2023.
The SR400 project is the first project in the MMIP program and the P3CommM is expected to continue to perform the same role in future phases of the program, as well as in other P3 projects that S&B might assign to the Atlanta office in the future.

Job Summary:
The P3 Commercial Manager:
 Will lead the commercial issues during preconstruction and delivery of the project, and, under the direction of and in coordination with the SVP of P3 Ops, act as the main point of contact with the client, partners and consultants and subs for commercial matters.
 In coordination with the Pre-construction Director, will ensure the bid documents preparation including the Technical Proposal, Estimate, Schedule and other required or supporting documentation, making sure that the delivered documents meet the RFQ/RFP requirements and are competitive to put the team in the best position to be awarded the project.
 In consultation with the P3 Pre-construction Director and the P3 Design Manager, will lead the review and negotiation of the agreements and other legal documents to be developed during the pre-construction phase.
 Will review the development, implementation, and management of the RFP and subsequent agreements to ensure contract requirements are duly followed.
 Is a highly experienced and personable leader with strong commercial skills, excellent strategic networking skills, capable of understanding and work across all elements of the project from technical to commercial.
 Will require to be a great communicator in English and with a good understanding of the transportation sector and business culture in the US.
 Must be collegiate and possess good soft skills to lead and persuade a diverse group of individuals to deliver both RFP work and subsequent agreements in a timely and efficient manner.
 Will work collaboratively with other team members to achieve goals, ask for inputs by valuing others ideas and expertise, and support and acts in accordance with final decisions, even when such decisions may not entirely reflect own position.
 Must have the experience and capacity to deliver the commercial support for large scale, highly important road construction projects involving complex technical issues.
Duties include, but are not limited to:
 Ensure compliance with the RFQ/RFP and subsequent agreements contractual terms.
 Support the executive and legal teams in the drafting and negotiation of agreements, change orders, subcontracts and other related documents.
 Review and approve all relevant correspondence to client, subs and consultants.
 Provide briefings on key contract terms.
 Regular reporting on specific commercial and contractual elements of the project.
 Provide support to the implementation of and, eventually, use of the client chosen contract management platform.
 Ensure the appropriate training is in place for the use of the contract management platform.
 Establish an audit process to ensure all records are kept accurately and in a timely manner.
 Work closely with the Project Controls Manager, the Design Manager and the Construction Manager to ensure effective management of the schedule, in compliance with the RFQ/RFP and subsequent agreements terms, including regular updates.
 Identify and ensure insurable events are notified, when required.
 Monitor and support the change order management process, including preparation and updating of the change order register.
 Monitor and support the claim management process, including preparation and updating of the claims register.
 Provide support to the updates of the project risks and opportunities matrix.
 Participate in the project progress meetings, internal and with the client.
 Identify opportunities to generate value in the project or to recover unexpected, incurred costs due to unforeseen circumstances.
 Participate in all actions related to the claims management process, and coordinate with the executive and legal teams all actions related to the claims management process.
 Ensure all claim-related documentation such as correspondence, meeting minutes, records, etc. is collected and stored accurately and in a timely manner.
 In case of a claim arises, participate in the selection of external experts and manage and supervise their work in preparing delay impact analysis and the quantum estimate
 Participate in the implementation of commercial management systems and ensuring best practices are followed in the selection, procurement, and performance management of consultants, sub-contractors and suppliers
 Participate in meetings with owners, developers, partners and subs
 Produce periodic Progress Reports, as required by the RFP.

Requirements:
 Bachelor's Degree from an accredited four-year college or university in Civil Engineering, Construction Management or equivalent is required.
 10 years of related work experience, with at least two projects bigger than $100M acting as Commercial or Contract Manager is required.
 Demonstrated successful experience in leading at least two claims/change orders larger than $5M is required.
 Knowledge and experience with Microsoft Word, Excel, and PowerPoint required.
 Demonstrated familiarity with E-Builder or other PC software packages typically associated with project management is also required.
 Demonstrated ability to establish and maintain good relationships and partnerships with clients, vendors, subcontractors and construction partners required.
 Design Build Institute of America (DBIA) is highly valuable.
 Experience and good relationship working with GDOT is highly valuable.
 P3 or Design Build experience in large projects (>$500M) on the contractor or designer side is highly valuable.
 Legal or Paralegal training and experience is highly valuable.
