POSITION SUMMARY


This position works on Compliance related tasks for the Tribe, and is not involved with the Compliance Department of the Gaming Commission with Red Hawk Casino.


Under the direction of the Compliance Manager, The Compliance Officer is responsible for management and oversight of the Tribe’s compliance program. This position will oversee development, implementation, and maintenance of the Tribe’s compliance program including all compliance requirements in accordance with Tribal policies and all applicable Federal and State laws.


The Compliance Officer will be professional, highly analytical, and possess excellent written and verbal communication skills. This position’s duties will include auditing the Tribe for compliance with applicable policies, reporting policy violations to Tribal leadership, developing Tribal compliance policies, and responding to policy violations.


This position will report to the Compliance Manager regarding day-to day operations and will also have direct access to the Legal Department, Chairperson and Compliance Committee for any compliance related recommendations, incidents or reporting needs.


SPECIFIC RESPONSIBILITIES


  • Assist in the implementation and management of an effective legal compliance program.
  • Prepare and distribute statements and reports to management and appropriate committees. Review, develop, and implement appropriate policies and procedures for compliant facility operations including employee onboarding and departure.
  • Work closely with the IT Department and Human Resources to assure that the Tribe’s privacy and security protections keep pace with technological advances.
  • Help develop and lead the compliance training program in collaboration with leadership and management.
  • Oversee acquisition and delivery of initial and ongoing compliance training programs for current and new employees of the Tribe and/or Tribal Business Associates.
  • Audit Tribal departments for compliance with applicable policies, laws, and regulations.
  • Audit Tribal contracts, licenses, and permits for compliance with applicable policies, laws, and regulations.
  • Review Tribal policies for compliance with applicable laws and regulations.
  • Advise Tribal leadership on the Tribe’s compliance with policies, laws, and regulations.
  • Create and manage effective action plans in response to audit discoveries and compliance violations.
  • Regularly audit Tribal departments, procedures, practices, and documents to identify possible weaknesses or risk.
  • Assess company operations to determine compliance risk.
  • Maintain a regulatory resource of compliance materials, including the most current regulations, interpretations, supervisory agency periodicals and examination handbooks, training materials, and current in-house manuals.
  • Coordinate distribution of compliance information/issues to appropriate parties including management and senior staff.
  • Coordinating and scheduling required compliance training for employees.
  • Ensure all employees are educated on the latest regulations and processes.
  • Resolve employee concerns about legal compliance.
  • Manages and coordinates the Tribe’s general insurance procurement and submits insurance policy renewal data.
  • Other duties as assigned.

MINIMUM QUALIFICATIONS


  • Bachelor’s degree or higher in legal studies, finance, human resources, business management or a similar field with two (2) years of compliance related work experience; or
  • Associate degree with four (4) years of compliance related work experience.
  • Certified Compliance & ethics Professional (CCEP) or ability to obtain certification within one (1) year of hire.
  • Strong knowledge of compliance standards and policies, federal laws, audit techniques, regulatory issues, operations, and procedures as they relate to the SSBMI Tribe.
  • Excellent oral and written communication skills and the ability to clearly communicate priorities and expectations in a positive manner.
  • Highly analytical with strong attention to detail.
  • Commitment to highest standards of compliance and ethics.
  • Must have valid, unrestricted California Driver’s license and personal vehicle insurance.

PREFERRED QUALIFICATIONS


  • Experience working for a Tribal government is preferred.

DRUG SCREEN

Shingle Springs Band of Miwok Indians requires the successful completion of a drug screening of all potential Tribal employees prior to being hired. The Tribe recognizes that the State of California has legalized the use of marijuana. The Tribe is located on federally owned trust land and complies with federal laws. Therefore, marijuana use is prohibited, and all drug tests will include a screening for THC.


Shingle Springs Band of Miwok Indians recognizes a zero-tolerance drug and alcohol policy, and employees will be required to sign a Consent to Drug and/or Alcohol Testing. Employees may be selected for alcohol / drug testing upon reasonable suspicion, and upon any/all accidents.

Candidates for this position will be subject to criminal and character background checks and fingerprinting prior to being hired. Verification of previous employment and education will also be conducted after the interview if an offer of employment is being considered.

Preference in hiring is given to the most qualified applicant. However, when candidates for an open position are determined to be equally qualified, Native American candidates will have preference for hiring purposes. This means that if the qualifications of the best candidates are comparable, the Native American candidate is given preference. The following order of preference shall be adhered to when hiring: (1) Members of Shingle Springs Band of Miwok Indians members; (2) Spouses or domestic partners (certified through Tribal Court or the State of California) of members of Shingle Springs Band of Miwok Indians; 3) Parents of children of the Shingle Springs Band of Miwok Indians; 4) All other documented Native Americans; 5) All other applicants in accordance with Title 25, U.S. Code, Section 472 and 473. Applicants claiming Indian preference must submit verification of Indian eligibility.
