Hill International is seeking a Senior Contract Manager in San Jose, California

  • Plans, manages, and implements the procurement of construction and professional services from cradle to grave and develops a Procurement Plan for BART Phase II project
  • Supervises, trains and guides staff with procurement and contract issues, including training staff on the risk profiles of different types of delivery methods, which informs on the manner in which the contract is to be managed and administered
  • Supervises, trains and guides staff on bid protests
  • Provides expert guidance in, and actual drafting and implementation of, as necessary, construction procurement and contract administration of contracts, including DB and CM/GC, and A&E Professional Services contracts
  • Evaluates market conditions with respect to the viability of upcoming construction contracts
  • Evaluates project risks and risk mitigation strategies
  • Oversees the preparation of Requests for Qualifications (RFQs), Requests for Proposals (RFPs), and Invitations for Bids (IFBs) and meets critical timelines for these procurements and ensures that Invitation for Bids and Request for Proposals are conducted consistent with appropriate contracting regulations
  • Reviews the solicitations (including attached plans, specifications, reports, and other documents) for consistency with the selected contract approach, redlines and revises documents as necessary and ensures that the solicitation documents are consistent with the Project Team’s approach of a project
  • Oversees and coordinates the development of contract language and ensures that VTA contracts are compliant with applicable laws and regulations
  • Conducts pre-bid/proposal conferences and bid/proposal openings
  • Evaluates proposals and determines responsiveness and responsibility
  • Provides guidance on proposal evaluation committees
  • Negotiates and prepares contracts that are highly complex and sensitive in nature
  • Coordinates with management and legal staff on legal issues associated with construction contracting and alternative project delivery
  • Has thorough understanding of FTA requirements for procurement and contracts; ensures FTA-compliant contract documentation
  • Manages the preparation and negotiation of construction change orders, ensures FTA-compliant change order documentation
  • Manages the preparation and negotiation of A&E professional services that are FTA-compliant. Understands the cost elements administration and management of same of A&E professional service contracts
  • Ensures that each procurement and contract action item includes a cost or price analysis. Understands and guides staff on “how to” of cost or price analysis
  • Evaluates bid protests and prepares timely draft of Final Decision on Protest to the Chief Procurement Officer
  • Processes claims and stop notices and works to resolve disputes and claims
  • Ensures compliance with VTA policies and procedures, including equal opportunity and discrimination and harassment prevention
  • Monitors, provides recommendations for revisions, and enforces VTA procurement policies and procedures
  • Manages the development and implementation of department goals, objectives, policies, and priorities for work unit
  • Ensures that VTA complies with the requirements of funding agencies for usage of grant funds
  • Performs related duties as required.

  • The candidate must have (significant) experience in developing procurement and contracts for transit construction projects.
  • Sufficient training, education, and public or private sector experience to demonstrate possession of the required knowledge, skills, and abilities in each of the areas listed under “Essential Job Functions.”
  • Development of the required knowledge, skills, and abilities is typically obtained through a combination of training and experience equivalent to graduation from an accredited college or university with a four-year degree, and substantial, increasingly responsible contract administration experience in a public transit agency involving highly complex, high dollar value contracts, with several years of supervisory experience.
  • A candidate who has significant number of years of experience in developing construction procurements, bid protests and construction claims, as legal counsel or otherwise, may be a strong candidate for this position.

  • Knowledge of:
    • Theories, principles, and practices of contract administration for public agencies including alternative delivery methods (e.g. DB, CM/GC)
    • Applicable local, state, and federal laws, rules, and regulations governing public procurement and contract administration processes for design build, construction, and professional services contracts
    • Principles and techniques of cost and price analysis, and good understanding of project cost and schedule terms and conditions in contracts (and how to manage a contract accordingly)
    • Principles and practices of training, oversight and management of personnel
    • Bid and contract analysis and preparation techniques
    • Cost elements of professional services contracts
    • General understanding of theories, principles, and practices of design management, construction management, quality assurance/quality control, and construction inspection
    • Theories, principles, and practices of claim avoidance and claim resolution
    • Applicable local, state, and federal laws, rules, and regulations governing public procurement and contract administration processes for construction contracts.
    • Federal and state requirements for conducting qualifications-based procurements, as detailed under the federal Brooks Act and in California Public Contract Code
    • FTA Triennial/FTA Procurement Systems Review – oversee that all Procurement and Contract files include FTA Triennial and Procurement Systems Review requirements
  • Ability to:
    • Manage and direct the operations, services, and activities of the unit
    • Prepare contracts, reports, and correspondence
    • Develop negotiations strategies and negotiate complex contracts and/or change orders
    • Define problems, evaluate, recommend and implement alternative solutions to complex issues and problems
    • Develop, implement, and interpret goals, objectives, policies, procedures, work standards, and internal controls
    • Interpret and effectively use management information reports
    • Understand, interpret, and apply laws, rules, regulations, policies and procedures
    • Communicate effectively both orally and in writing
    • Plan and prepare a procurement plan based on project cost and schedule
    • Establish and maintain effective relationships with those contracted in the course of work.

The salary range for this position is $165,000 - $205,000. The offered salary will be based on the applicants qualifications, education, experience and work location.
